This Legal Notice and Conditions of Use (hereinafter, “Legal Notice and Conditions of Use”), regulate the access and use of these Internet portals: www.gva-automation.com and www.gva-engineering.com (hereinafter, “websites”), ownership of the company, “GVA AUTOMATION OÜ”.

Acceptance

The browsing, as well as the simple access to the websites and/or the mere use of the services offered through it, give the condition of user of said websites (hereinafter, “user”) and imply full acceptance and without reservation of those of the conditions included in this Legal Notice and Conditions of Use, in the version published by GVA at the same time that the user accesses the websites.

GVA reserves the right to unilaterally modify, at any time and without prior notice, the clauses contained in this Legal Notice and Conditions of Use, as well as the configuration and, in general, any other content or service of its websites. The use of the services and/or the simple access to the websites will imply the acceptance of any modification introduced. Therefore, GVA recommends periodically consulting this document, as well as its subsequent modifications.

Likewise, the use of the websites is subject to all legal notices, regulations of use or instructions made known to the user through these websites and that substitute, complete and/or modify this Legal Notice.

Use of the Websites

Unless otherwise provided, the use of the websites will be free of charge, without prejudice to the cost of connection through the corresponding telecommunications network so that the user has access. The user is aware and voluntarily and expressly accepts that the use of the websites is in any case under his sole and exclusive responsibility. The user agrees to use the websites as well as its services and contents without contravening current legislation, good faith, generally accepted uses and public order.

Likewise, the use of the websites for illegal or harmful purposes for GVA or any third party is prohibited.

During the use of the websites, the user undertakes not to carry out any conduct that could damage the image, interests and/or rights of GVA and/or third parties or that could damage, disable or overload the websites, or that would prevent in any way, the normal use of the websites, computer equipment or documents, files and all kinds of content stored on any GVA computer equipment of other users or any other Internet user (hardware and software).

Intellectual and industrial property

All industrial and intellectual property rights, as well as all the information contained in the websites (images, brands, graphic designs, source code, design, browsing structure, databases, and any other content that in the same appears) are the exclusive property of GVA or, where appropriate, duly licensed by the owner. The names of other products, services and companies that appear in this document or on the websites may be trademarks or other distinctive signs registered by their respective and legitimate owners, without it being understood that access or use of the websites gives the user any right over the aforementioned marks and the other registered distinctive signs. Likewise, all the information and contents of the websites are protected by copyright and their intellectual property belongs to GVA or, where appropriate, its use and exploitation has been duly authorized by the owner, without being understood to be assigned to the user, none of the exploitation rights related to them beyond what is strictly necessary for the correct use of the websites.

The user is not authorized to delete, evade, manipulate the “copyright” and other data identifying the rights of GVA, as well as any protection mechanisms.
The user is not authorized to disassemble, decompile or reverse the databases in which the websites information is stored.

The unauthorized use of the information contained in these websites, its resale, as well as the infringement of the industrial and intellectual property rights of GVA, will give rise to the legally established responsibilities.

Limitation of liability

GVA reserves the right to interrupt access to its websites, as well as the provision of any or all of the content and/or services offered through it at any time and without prior notice, whether for technical, safety, control, maintenance or any other reason.

Consequently, GVA does not guarantee the reliability, availability or continuity of its websites or the contents offered therein, so access to the websites and its contents by the user is at your own risk.

Likewise, GVA will not be responsible for temporary service interruptions, delays, errors, malfunctions and, in general, other inconveniences that have their origin in causes beyond the control of GVA, and/or due to the malicious or guilty actions of the user and/or come caused by force majeure.

In this sense, GVA is excluded, to the full extent permitted by the legal system, from any liability for damages that may be due to any lack of availability or continuity of the operation of the websites and/or services, to the unreliability of the websites and/or of the services, to the failures in the access to the different web pages of the websites or to those from which the services are provided.

GVA adopts reasonably adequate security measures to detect the existence of viruses and/or malware. However, the user must be aware that the security measures of computer systems on the Internet are not entirely reliable and that, therefore, GVA cannot guarantee the absence of viruses or other elements that may cause alterations in computer systems (software and hardware) of the user or in their electronic documents and files contained therein.

In this sense, GVA excludes to the full extent permitted by the legal system, any liability for damages of any nature that may be due to the presence of viruses or other elements in the contents of the websites, which may cause alterations in the computer system, electronic documents and / or in the files of the users.

Finally, GVA not assume the liability for the use that the user makes of the websites content that may be a violation of any type of rule, national or international, intellectual property rights, or industrial, or any other third party right.

Both the access to the websites and the use that can be made of the information contained therein is the sole responsibility of the person who makes it. GVA shall not be liable for any consequence, damage or harm that may arise from such access or use of the information. GVA is not responsible for any security errors that may occur or for any damage that may be caused to the user’s computer system (hardware and software), the files or documents stored therein, as a consequence of a bad functioning of the browser or the use of outdated versions.

GVA is not responsible for damages arising from the use of the contents of the websites. Specially, GVA is not responsible for the contents or the status of the links or links contained in these websites and that may lead the user to other sites and websites managed by third parties. GVA is not responsible for the contents or the status of such websites and websites. Access to them through these websites also does not imply that GVA recommends or approves its contents.

Notifications

All notices and communications (hereinafter, “notifications”) by the user to GVA shall be deemed effective, for all purposes, when they are directed to the following email address: legal@gva-engineering.com In addition, all notifications made by GVA to the user will be considered validly made if they have been made using the data and through the means indicated above. For this purpose, the user represents and guarantees that all the data provided by him are true and correct and that he will keep them duly updated.

These websites has always been developed in accordance with the principles of good faith by GVA. However, if any third party considers that their intellectual and/or industrial property rights have been infringed, they may notify them by means of a communication addressed to the address of GVA indicated above.

Withdrawal and suspension of the service

GVA may withdraw or suspend at any time and without prior notice the provision of the services offered through the websites to those users who fail to comply with the provisions of this Legal Notice and Terms of Use.

Duration and termination

The existence of the websites, as well as the provision of the services offered therein, has, in principle, an indefinite duration. However, GVA is entitled to terminate or suspend the provision of the aforementioned services and cancel the websites at any time, without prejudice to what has been provided in the corresponding Particular Conditions. Where this is reasonably possible, GVA will warn users in advance about the termination or suspension of the websites as well as, where applicable, the services offered therein.

Applicable law and jurisdiction

Any dispute related to the use of these websites will be subject to Estonian law, being competent for the resolution of any questions that may arise or actions to be exercised derived of the provision of the services and/or contents of the websites, as well as on the interpretation, application, compliance and/or non-compliance with the established herein, the Courts and Tribunals of the city of Tallinn, unless by mandatory rule it is established a different jurisdiction.
